These Terms of Service ("Terms") are an agreement between you and Haro Health LLC ("Haro Health," "we," "us," or "our"). They govern your use of harohealth.com and related services, content, customer accounts, purchases, subscriptions, reviews, referral or affiliate features, and communications (collectively, the "Services"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and accounts

You must be at least the age of majority where you live to place an order. You may browse and may be able to check out as a guest. An account is optional unless a feature specifically requires one. If you create an account, provide accurate information, protect your credentials, and promptly notify us of suspected unauthorized use. You are responsible for activity under your account to the extent permitted by law.

2. Product information and health disclaimer

Haro Health products are dietary supplements, not drugs. Website content is provided for general educational and informational purposes and is not medical advice, diagnosis, or treatment. Statements about dietary supplements have not been evaluated by the U.S. Food and Drug Administration, and products are not intended to diagnose, treat, cure, or prevent disease. Consult a qualified healthcare professional about your individual needs, medications, conditions, pregnancy or nursing, and before starting or changing a supplement. Seek emergency care for a medical emergency.

We work to describe products accurately, but packaging, images, colors, ingredient sourcing, and product details may change. Read the label delivered with the product and follow its directions. Website content does not guarantee individual results.

3. Orders, pricing, and payment

By submitting an order, you offer to purchase the listed products under these Terms and the disclosures shown at checkout. We may accept, reject, limit, or cancel an order for reasons including availability, pricing or listing errors, suspected fraud, unauthorized resale, legal restrictions, or delivery limitations. If we cancel after payment, we will refund the cancelled amount.

Prices are shown in the selected currency where available. Taxes, delivery charges, duties, and other charges are displayed or calculated as described at checkout. You authorize us and our payment providers to charge the payment method you select. Title and risk of loss pass as provided by applicable law; nothing in this section limits non-waivable consumer rights.

4. Shipping, returns, and refunds

Our Shipping Policy explains available services, estimates, rates, international charges, and delivery limitations. Delivery dates are estimates unless applicable law requires otherwise.

Our Return and Refund Policy explains the 30-day first-order satisfaction guarantee, eligibility, return instructions, and refund process. Those policies are incorporated into these Terms. If a mandatory consumer law provides additional rights, that law controls.

5. Subscriptions and automatic renewal

Some products are offered through automatically renewing subscriptions. Before you subscribe, checkout displays the product, quantity, delivery frequency, price, discount, recurring billing terms, and any applicable shipping or tax. By completing a subscription purchase, you authorize recurring charges to your selected payment method until cancellation.

You may manage, skip, pause, or cancel through your customer account or the subscription-management link in subscription emails, or request help at hello@harohealth.com. To avoid a future charge, cancel before that order is processed. Cancellation stops future recurring orders and does not automatically cancel or refund an order already processed. We will provide notice of material subscription or price changes when required. If payment fails, we or our subscription provider may retry the charge, request an updated payment method, pause service, or cancel the subscription, subject to applicable law.

6. Resale, clinics, referrals, and affiliates

Consumer purchases are for personal use and not unauthorized resale. Contact us about approved clinic, wholesale, or distribution opportunities. We may limit quantities or cancel orders reasonably believed to involve unauthorized resale.

Referral, affiliate, clinic, and promotional programs may have additional terms displayed when you join. Participants must make clear and conspicuous disclosures of material relationships, use truthful claims, and comply with applicable advertising, endorsement, platform, and healthcare-professional rules. We may withhold benefits or end participation for fraud, abuse, misleading promotion, or violation of program terms.

7. Reviews and user content

If you submit a review, image, comment, testimonial, or other content ("User Content"), you represent that it is truthful, based on your genuine experience, owned by you or lawfully submitted, and does not violate another person's rights or applicable law. Do not include patient information, confidential information, unlawful medical claims, or content that is deceptive, harassing, infringing, or harmful.

You retain ownership of User Content. You grant Haro Health a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, reproduce, format, publish, display, distribute, and use it in connection with the Services and lawful promotion of our business. We may moderate or remove User Content but are not required to publish it. We do not promise compensation unless separately agreed in writing.

8. Intellectual property

The Services and their text, graphics, photographs, video, layout, software, trademarks, and other content are owned by or licensed to Haro Health and protected by law. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the Services for personal, lawful purposes. You may not copy, scrape, modify, distribute, sell, reverse engineer, interfere with, or exploit the Services except as permitted by law or with our written consent.

If you believe content on the Services infringes your copyright or trademark rights, contact hello@harohealth.com with identification of the work, the allegedly infringing material and its location, your contact details, a good-faith statement, a statement under penalty of perjury that the notice is accurate and you are authorized to act, and your signature.

9. Acceptable use

You may not use the Services to violate law or another person's rights; submit false or misleading information; distribute malware or spam; collect information about others without authorization; interfere with security or operation; evade purchase limits; impersonate another person; or make unauthorized, false, or misleading claims about Haro Health products. We may suspend or terminate access and cooperate with lawful investigations.

10. Third-party services and links

The Services may contain third-party applications, payment services, links, content, marketplaces, or social features. We do not control third-party services, and their terms and privacy notices govern your use of them. References to third parties do not imply endorsement unless expressly stated.

11. Electronic communications and mobile messages

You agree to receive transactional electronic communications related to orders, accounts, subscriptions, security, and these Terms. Marketing email and text messages require the permissions described at signup and can be stopped using the unsubscribe link or by replying STOP. Consent to marketing texts is not a condition of purchase. Message frequency varies and message and data rates may apply. Reply HELP or contact hello@harohealth.com for assistance. Carriers are not liable for delayed or undelivered messages.

Our Privacy Policy explains how we handle personal information and the choices available to you.

13. Disclaimer of warranties

To the maximum extent permitted by law, the Services are provided "as is" and "as available." Haro Health disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted or error-free operation, that content is complete or current, or that any product will produce a particular result. Some jurisdictions do not allow certain disclaimers, so these limitations may not apply to you. Nothing in these Terms excludes express product warranties or statutory rights that cannot lawfully be excluded.

14. Limitation of liability

To the maximum extent permitted by law, Haro Health and its officers, employees, affiliates, agents, licensors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or loss of profits, revenue, data, goodwill, or use, arising from the Services or products, even if advised of the possibility.

To the maximum extent permitted by law, Haro Health's aggregate liability arising from the Services or products will not exceed the amount you paid Haro Health for the product or service giving rise to the claim during the three months before the event. These limitations do not apply where prohibited, including liability that cannot be limited for personal injury, fraud, gross negligence, willful misconduct, product liability, or mandatory consumer protections.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold Haro Health and its officers, employees, affiliates, and agents harmless from third-party claims, losses, and reasonable costs arising from your unlawful use of the Services, User Content, unauthorized resale, or violation of these Terms or another person's rights. This section does not require you to indemnify a party for its own unlawful conduct and does not limit non-waivable consumer rights.

16. Dispute resolution and arbitration

Please read this section carefully. It affects the right to a jury trial and to participate in a class action.

Before filing a claim, you and Haro Health agree to attempt informal resolution for 30 days. Send a written notice describing the claim and requested relief to hello@harohealth.com and Haro Health LLC, 4880 Lower Roswell Rd., Ste. 165-202, Marietta, GA 30068 USA. Haro Health will send notices to the contact information associated with your order or account.

Except for eligible individual claims in small-claims court, requests for public injunctive relief where applicable law does not permit arbitration, claims concerning intellectual-property misuse, or matters a party may report to a government agency, disputes arising from these Terms, the Services, or products will be resolved by individual binding arbitration administered by the American Arbitration Association under its then-current Consumer Arbitration Rules. The Federal Arbitration Act governs this arbitration provision. Hearings may occur remotely, in Cobb County, Georgia, or in the federal judicial district containing your billing address, as the rules or arbitrator permit. Haro Health will pay fees it is required to pay under the applicable consumer rules. The arbitrator may award the same individual remedies a court could award.

You and Haro Health waive the right to a jury trial and agree that claims may be brought only individually, not as a plaintiff or class member in a class, collective, consolidated, or representative action, to the extent permitted by law. If the class-action waiver is unenforceable for a particular claim or remedy, that portion will proceed in a court of competent jurisdiction after arbitrable matters are completed.

You may opt out of arbitration by sending a signed written notice within 30 days after first accepting these Terms. Include your name, address, order or account email, and a clear statement that you opt out of arbitration. Send it to the mailing address above. Opting out will not affect your relationship with Haro Health.

17. Governing law

Except as governed by the Federal Arbitration Act or mandatory law where you live, these Terms are governed by Georgia law, without regard to conflict-of-law rules. Any dispute permitted to proceed in court will be brought in the state or federal courts serving Cobb County, Georgia, unless applicable law allows or requires another forum. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

18. Changes, suspension, and termination

We may update the Services or these Terms. The effective date identifies the current version. We will provide additional notice of material changes when required. Changes apply prospectively and do not alter the terms governing an order already accepted, except where required or agreed. You may stop using the Services at any time. We may suspend or terminate access for violations, fraud, security risk, or legal reasons.

19. General terms

If part of these Terms is unenforceable, it will be modified to the minimum extent necessary or severed, and the rest will remain effective, except as stated in the arbitration section. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, reorganization, sale, or transfer of our business. These Terms, together with incorporated policies and checkout disclosures, are the agreement between you and Haro Health concerning the Services. Provisions that by their nature should survive will survive termination.

Mandatory consumer rights and remedies remain available. If these Terms conflict with non-waivable law, that law controls.
